These Terms of Use ("Terms") govern your access to and use of the PatchedSkull website and your purchase of products from us. PatchedSkull ("we," "us," or "our") operates this store. By visiting the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

1. Eligibility

You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order. By placing an order you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Your account

If you create an account, you're responsible for keeping your login credentials confidential and for all activity that occurs under your account. Tell us promptly if you believe your account has been compromised. We may suspend or close accounts we reasonably believe are being used fraudulently or in violation of these Terms.

3. Products, descriptions, and availability

We work to describe our products accurately, including materials and dimensions. Even so, product photography and screen settings vary, so colors and finishes may appear differently on your device than in person. Measurements are approximate.

Our jewelry is fashion jewelry and is intended for everyday personal wear. It is not medical, protective, or performance equipment, and we make no claims about health, wellness, or metaphysical effects.

All products are subject to availability. We may change, limit, or discontinue any product at any time without notice.

4. Pricing and errors

All prices are listed in U.S. dollars and exclude taxes and shipping unless stated otherwise. Applicable sales tax and shipping are calculated at checkout.

Despite our best efforts, occasionally a product may be listed at an incorrect price or with incorrect information. We reserve the right to correct any errors and to cancel or refuse any order placed at an incorrect price, even after an order has been submitted or confirmed. If we cancel your order for this reason, we'll notify you and issue a full refund.

5. Orders

Your order is an offer to purchase. We may accept or decline any order at our discretion, including where we suspect fraud, where a product is unavailable, or where a pricing error has occurred. Order confirmation emails acknowledge receipt of your order; acceptance occurs when we ship.

We may limit quantities per person, per household, or per order.

6. Shipping, returns, and refunds

Shipping is governed by our Shipping Policy, and returns and refunds are governed by our Returns & Refunds policy. Both are incorporated into these Terms by reference.

7. Intellectual property

The PatchedSkull name, logo, one-eyed skull mark, site design, text, graphics, and other content are owned by us or our licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission. Nothing on this site grants you a license to use our trademarks.

8. Reviews and submissions

If you submit a review, comment, photo, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and adapt that content in connection with our business, including in marketing.

You agree that anything you submit is your own honest experience, is accurate, and does not violate anyone else's rights. We do not offer compensation in exchange for positive reviews, and we do not edit, suppress, or fabricate reviews. We may remove content that is unlawful, abusive, off-topic, or that we reasonably believe to be fraudulent.

9. Acceptable use

You agree not to use the site to break any law, infringe anyone's rights, transmit malware, scrape or harvest data, interfere with the site's operation or security, impersonate another person, or attempt to gain unauthorized access to any part of the site or its systems.

10. Third-party links and services

Our site may link to or rely on third-party websites and services, including payment processors and shipping carriers. We don't control those parties and aren't responsible for their content, policies, or practices. Your dealings with them are between you and them.

11. Disclaimer of warranties

The site and its content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We don't warrant that the site will be uninterrupted, secure, or error-free.

Nothing in these Terms limits any rights you may have under applicable consumer protection law that cannot be waived.

12. Limitation of liability

To the fullest extent permitted by law, PatchedSkull and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of or relating to your use of the site or any product purchased from us. Our total liability for any claim relating to a product will not exceed the amount you paid for that product.

13. Indemnification

You agree to indemnify and hold harmless PatchedSkull and its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the site.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or your use of the site will be brought exclusively in the state or federal courts located in Brevard County, Florida, and you consent to the jurisdiction of those courts.

15. Changes to these Terms

We may update these Terms from time to time. The version posted on this page is the version in effect. Changes take effect when posted, and the "Last updated" date above will reflect the most recent revision. Your continued use of the site after changes are posted means you accept them.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
